«ΤΑΦΟΠΛΑΚΑ» ΣΤΗ ΔΡΑΣΗ ΤΩΝ ΦΙΛΟΖΩΙΚΩΝ ΣΩΜΑΤΕΙΩΝ ΒΑΖΕΙ Η ΚΤΗΝΙΑΤΡΙΚΗ ΥΠΗΡΕΣΙΑ

Συνέντευξη τύπου παραχώρησαν σήμερα εκπρόσωποι των φιλοζωικών σωματείων και της Πανελλαδικής Φιλοζωικής και Περιβαλλοντικής Ομοσπονδίας, μετά την επιστολή που έστειλε η κτηνιατρική υπηρεσία Χανίων στην Πρόεδρο της Ομοσπονδίας μας κα Μπομπολάκη, η οποία αποτελούσε απάντηση σχετικά με τη διαδικασία υιοθεσίας και μετακίνησης ζώων συντροφιάς στο εξωτερικό.

Στην απάντησή της η κτηνιατρική υπηρεσία αποφαίνεται ότι «στην περιφέρεια των Χανίων δεν μπορεί να πραγματοποιηθεί νόμιμη διαδικασία υιοθεσίας αδέσποτου ζώου συντροφιάς. 

Όπως επεσήμανε η κα Μπομπολάκη «Η επιστολή της Κτηνιατρικής Υπηρεσίας Χανίων ούτε λίγο ούτε πολύ βάζει ταφόπλακα στη φιλοζωική δράση όχι μόνο των φιλοζωικών σωματείων αλλά και των Δημοτικών Αρχών. Κι αυτό γιατί σύμφωνα με την απόφαση αυτή (η οποία βασίζεται σε μια διάταξη του νόμου 4039 χωρίς να λαμβάνει υπόψη άλλες συναφείς διατάξεις) επειδή τόσο ο Δήμος όσο και τα φιλοζωικά σωματεία δεν έχουν αδειοδοτημένα καταφύγια ζώων ή κτηνιατρεία, μας δηλώνεται ανοιχτά ότι δεν μπορούμε να περισυλλέγουμε κανένα ζώο είτε αυτό είναι τραυματισμένο είτε άρρωστο είτε μικρά κουτάβια και δεν μπορούμε να προβαίνουμε σε υιοθεσίες ζώων. Γενικά, δηλαδή, αναστέλλεται κάθε φιλοζωική δραστηριότητα».

Συνεχίζοντας χαρακτήρισε «κατάπτυστη, παράλογη και απαράδεκτη» την επιστολή και πρόσθεσε πως ήδη τα σωματεία προχώρησαν σε εξώδικη διαμαρτυρία ζητώντας από την Υπηρεσία και τα αρμόδια Υπουργεία μέσα σε 7 ημέρες να προσαρμοστούν στις ευρωπαϊκές διατάξεις, οι οποίες ορίζουν ότι προκειμένου ένα ζώο να υιοθετηθεί σε άλλες χώρες – μέλη της Ε.Ε. θα πρέπει να συνοδεύεται από ένα πιστοποιητικό υγειονομικού χαρακτήρα (trace) το οποίο πρέπει να εκδίδει η Κτηνιατρική Υπηρεσία.

Σχετικά με τα καταφύγια ζώων που προβλέπονται να υπάρχουν βάσει του νόμου 4039/2012 αλλά ακόμα δεν έχει εκδοθεί η υπουργική απόφαση η οποία θα θέτει τις προϋποθέσεις δημιουργίας τους, επομένως «ακόμα κι αν ήθελε ο Δήμος ή ένα φιλοζωικό σωματείο να έχει αυτό το πράγμα δεν μπορεί να το κάνει.

Από εκεί και πέρα υπάρχει η αρ. 130 γνωμοδότηση του Νομικού Συμβουλίου του κράτους, την οποία έχει επικυρώσει ο αρμόδιος υπουργός του ΥΠΠΑΤ και η οποία έχει δεσμευτική ισχύ για τις δημόσιες υπηρεσίες και όχι μόνο, που λέει ότι εκεί όπου δεν υπάρχουν καταφύγια ζώων από Δήμους -και επειδή δεν μπορούμε να αφήσουμε τα αδέσποτα στο έλεος του καθενός- μπορούν τα φιλοζωικά σωματεία προσωρινά να φιλοξενούν άρρωστα, τραυματισμένα ζώα κ.λπ. Αυτή όμως την παράμετρο δεν την λαμβάνει υπόψη της η Κτηνιατρική Υπηρεσία.

Εφόσον η Υπηρεσία εμμείνει στο περιεχόμενο της επιστολή της, πρόθεση των σωματείων είναι να εγκαταλείψουν όλα τα ζώα που περιθάλπονται ή φιλοξενούνται από τα φιλοζωικά σωματεία στα γραφεία της Κτηνιατρική Υπηρεσία Χανίων.

Να απαγορεύεται κάτι χωρίς να βρίσκεται λύση δεν είναι εφικτό. Γι’ αυτό και όλα τα ζώα θα τα πηγαίνουμε στην Κτηνιατρική μέχρι να αποφασίσει ότι αυτή η επιστολή δεν έχει εφαρμογή», σχολίασε η κα Μπομπολάκη και διευκρίνισε ότι η απόφαση των φιλοζωικών οργανώσεων θα υλοποιηθεί αφότου υπάρξει επικοινωνία με την Κτηνιατρική και με το Υπουργείο έπειτα από το εξώδικο της ΠΦΠΟ που τους έχει κοινοποιηθεί.

This Monday the Veterinary Department of Chania made an announcement effectively banning the existence of animal shelters and forbidding any animal welfare work generally, such as tending and sheltering wounded or very young animals. This has caused outrage among animal lovers and the following has been issued by the President of the Panhellenic Animal Welfare and Environmental Federation (PFPO) following the press conference on 29th August 2016 (translated)

Letter of the Veterinary Service Places a “Gravestone” to the Animal Welfare Activity
Τhe Veterinary Service of Chania (VeSC) with its letter places a “Gravestone” to the activity of the Animal Welfare Associations as well as the Municipalities, which do not owe licensed shelters, according to the Animal Welfare Organizations. The Panhellenic Animal Welfare and Environmental Federation (PFPO) has already proceeded to an extrajudicial complaint, while the local Associations notify in advance that if the content of the letter will not be suspended then they will abandon all the animals they take care of outside the offices of the VeSC.
Members of animal Welfare Associations of Chania denounced the above during a Press Conference that took place on Monday. The President of the PAWEF Natasha Bobolaki emphasized the fact that the letter of the VeSC came as an answer to a request of the Animal Welfare Associations to this Service.

Mrs. Bobolaki pointed out that “The letter of the VeSC in other words stops not only the animal welfare activity but also the Municipality Authorities ‘activities. This is so, since in this letter-decision (which is based to a provision of Law 4039, not considering the rest of relative provisions) and since the Municipality as well as the Animal Welfare Associations do not owe licensed shelters or vet clinics, it is claimed openly that we cannot shelter any animal whether it is wounded or ill or little puppies and we cannot proceed to animal adoptions. Generally any animal welfare activity is discontinued”.

In continuation she characterized the VeSC letter as “despicable, irrational and unacceptable” and she added that the Associations have already proceeded to extrajudicial complaint, asking the Service and the authorized Ministries within 7 days to conform to the European provisions, which define that in order an animal to be adopted in other countries – members of the EC should be accompanied by a certification of a sanitary nature (trace), which has to be edited by the Veterinary Service.

As concerns the animal shelters Mrs. Bobolaki pointed out that the Law defines that shelters should exist, but for the last 5 years no Ministry decision, which would define the preconditions of their creation has been edited. “Hence, even if the Municipality or any Animal Welfare Association would like to build one, this would not be possible. Furthermore the consultatory response no 130 of the Juridical Council of the country, which has been certified by the authorized Minister of the Hellenic Ministry of Rural Development and Food, which commits the public services and which states that where there are no Municipal animal shelters – and because we cannot leave the stray animals on anybody’s mercy – the Animal Welfare Associations may temporarily foster ill, injured, e.t.c. animals. But this parameter is not considered by the Veterinary Service”.

Ending, Mrs. Bobolaki underlined the fact that the Animal Welfare Organizations are determined to abandon all the animals they take care of or they foster at the VeSC offices, if the Service will hold to or persists in its letter’s content. “To prohibit something without proposing a solution is not a wise confrontation of any problem. That is why all the animals will be taken to the Veterinary Service, till they will decide that their letter cannot be implemented” Mrs. Bobolaki commented and she clarified that the associations’ decision will be materialized after communication with the Veterinary Service and the Ministry, following the extrajudicial complain.
